Resume Hype - Terms of Service


Use of Resume Hype service constitutes acceptance and agreement to Resume Hype Acceptable Use Policy as well as Resume Hype Terms of Service. From herewith in this TERMS OF SERVICE, ACCEPTABLE USE POLICY , and SERVICE LEVEL AGREEMENT, the use of "us", "we", "our", "ours" shall constitute reference to Resume Hype, the usage of "you", "your", "they", "them" shall refer to customers of Resume Hype.

- Acceptance of Contractual Agreement

1. Customer agrees that by placing an order either by means of electronic ordering (web order form) or submitting a written contract, and receipt of such order by Resume Hype, that you are agreeing to our TERMS OF SERVICE, ACCEPTABLE USE POLICY , and SERVICE LEVEL AGREEMENT. No modifications of said contract by customer are allowed.

2. Resume Hype will provide, and Customer will purchase and pay for, the services, and service fees specified in the Order for the applicable service description. Customer acknowledges that the service, and service fees have been communicated to the customer, and that they are aware of all applicable charges as per contract, ACCEPTABLE USE POLICY, SERVICE LEVEL AGREEMENT, and TERMS OF SERVICE. Customer also understands that any promotional offers unless specified in contractual terms will not be applicable to their individual service.

2a. Automatic Account Renewal is one (1) day prior to the expiration of Customer's resume website account, Resume Hype will automatically renew Customer's resume website account, for the same duration initially selected, at the then-current, non-promotional rate, by charging the applicable fee to Customer's originally-selected method of payment.

- What May NOT Be Hosted:

  • Warez
  • IRC
  • Child pornography
  • Copyrighted media, includes but not limited to: Video, Music, TV, Radio
  • Hacking tools / material
  • Anything that may harm us, the server, or anyone else (mentally, physically)

- Uptime is the total time in a calendar month that Resume Hype is available through the Internet, provided that Customer has established connectivity. Resume Hype takes responsibility for availability within their control , however, we cannot be held liable for upstream problems, outside of our control . Our guarantee is that our resume sites will be available to customers free of outages that render 100% packet loss, 99% of each calendar month.

- Outages or Unscheduled Downtime is any unplanned or unscheduled interruption in Service availability during which Customer is unable to access the services as described in the section titled "Uptime" above. A Outage is defined as a period in which 100% packet loss is experienced, which is determined to have been caused by a problem in Resume Hype as confirmed by Resume Hype. Downtime or outages are measured as the total length of time of the unplanned interruption in service availability in a calendar month.

- Scheduled Downtime is any Resume Hype scheduled interruption of Services, for the purpose of upgrades, or replacement of any equipment in order to provide for you better service. Scheduled downtime occurs during notified downtime periods, with as much advance warning as possible via e-mail with a minimum of 12- 24 hours notice.

- Service Level Agreement; Violation Credit

Performance Credit exclusions: The following are excluded from the monthly calculation of Service Availability:

  • Scheduled downtime.
  • Problems outside of Resume Hype (upstream providers, or customer's inbound connection) not effecting 100% loss.
  • Interruptions or failure of individual service caused by customer, customer's contacts, etc. to their service. These include inaccurate configuration, 3rd party software, and customer abuse or over utilization of resources, hacked servers, attacks, exploits, server hardware failures or other users on server to cause the server to overload which may cause downtime. We will do our best to remove such offenders immediately.

- Payments and Fees Payment is due every month by credit card or PayPal, an invoice can be produced if requested in writing within seven days of billing.

- Delinquent Accounts
Resume Hype may temporarily deny service or terminate this Agreement upon failure of Customer to pay charges when due. Such termination or denial will not relieve Customer of responsibility for the payment of all accrued service fees, or any collection fees.

- Account Cancellation
All requests for canceling any service(s) must be made in writing with at least 15 days notice but not more than 30 days prior to billing, written via email to cancel@resumehype.com; include your domain name and last name on credit card in your email.

- Refunds and Disputes
All payments to Resume Hype are non refundable. This includes any setup fees and monthly fees regardless of usage. All billing disputes must be reported within 30 days of the time the dispute occurred. Disputed charges to your credit card issuer, also known as charge backs, in Resume Hype discretion which is valid, under the terms and conditions of our SERVICE LEVEL AGREEMENT, ACCEPTABLE USE POLICY, and TERMS OF SERVICE, will result in service interruption or termination of account.

- Modification
Resume Hype reserves the right to add, delete, or modify any provision of this Policy at any time without notice.

Resume Hype - Service Level Agreement

- Coverage
This Resume site Availability Service Level Agreement applies to you if you have ordered a Resume site ("Service") and you are in good financial standing with Resume Hype.

- Service Level Resume Hype endeavors to have connectivity available for http access by third parties 99% of the time ("Resume site Availability").

- Credits
In the event that there is no Resume site Availability, Go Green Resumes will credit the monthly service charge for the Service as calculated below and as measured 24-hours a day in a calendar month, with the maximum credit not to exceed the monthly service charge for the affected month: Resume site Availability Credit 95% to 99.4% = 25% 90% to 94.9% = 50% 89.9% or below = 100% In order for you to receive a credit on your account, you must request such credit within seven (7) business days after you experienced no Resume site Availability. You must request credit by sending an electronic mail message to support@resumehype.com. For security, the body of this message must contain your account number/domain name, the dates and times of the unavailability of your resume site, and such other customer identification requested by Resume Hype. Credits will usually be applied within sixty (60) days of your credit request. Credit to your account shall be your sole and exclusive remedy in the event that there is no Resume site Availability.

- Restrictions
Credits shall not be provided to you in the event that you have no Resume site Availability resulting from (I) Scheduled maintenance, (II) Your behavior or the performance or failure of your equipment, facilities or applications, or (III) Circumstances beyond Resume Hype reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of your Resume site.

- Limitations
On-line problems occur continuously. There might come a time when you cannot access your website or any other service. This is not necessarily due to Resume Hype. Perhaps your ISP is experiencing technical difficulties, or there might be a routing problem between your ISP and Go Green Resumes, making communication difficult or impossible. We cannot bear the responsibility of such problems. Our monitoring agents determine the uptime of our service, and not any one customer's experience.

- Modification
Resume Hype reserves the right to add, delete, or modify any provision of this Policy at any time without notice.

Resume Hype - Acceptable Usage Policy

Resume Hype is dedicated to providing a quality service. The terms and conditions which follow are necessary to ensure that we may continue to provide the best possible service to all of our customers while at the same time satisfying our legal and ethical responsibilities.

Failure to follow any term or condition will be grounds for immediate account deactivation without notice Resume Hype will be the sole arbiter as to what constitutes a violation of any of these provisions.
Activity which results in the suspension or deactivation of an account will result in a forfeiture of all fees paid.
Complaints made regarding abuses of an account will be investigated and if found guilty will be grounds for immediate suspension.

- Ownership of Resume Hype Custom Templates
Copyright to the Custom Templates used to create the customer custom resume web site is the sole property of Resume Hype Customers of Resume Hype are granted non-exclusive rights to the use of our Custom Templates for as long as the Customer is in good standing with Resume Hype. The Customer may never download their site or any site on Resume Hype server(s) to any other server or storage facility.

- Illegal Usage
Resume Hype servers may be used for lawful purposes only.

Transmission, storage, or distribution of any information, data or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of non-acceptable content or links: Pirated software, Hackers programs or archives, Warez sites, MP3, and IRC bots.

The subscriber to Resume Hype service agrees to indemnify and hold harmless Resume Hype from any claims resulting from the use of the service that damages the subscriber or any other party. Resume Hype will be the sole arbiter as to what constitutes a violation of this provision.

- Adult Content
Adult Content is not allowed.

- Security
Violations of system or security are prohibited, and may result in criminal and civil liability. Examples include, but are not limited to the following: Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

- Data Security
Resume Hype incorporates physical, electronic, and administrative procedures to safeguard the confidentiality of your personal information, including Secure Sockets Layer ("SSL") for all financial transactions through this site. We use SSL encryption to protect your personal information online, and we also take several steps to protect your personal information in our facilities. Access to your personal information is restricted. Only employees who need access to your personal information to perform a specific job are granted access to your personal information. Finally, we rely on third-party service providers for the physical security of some of our computer hardware. We believe that their security procedures are adequate. For example, when you visit our site, you access servers that are kept in a secure physical environment, behind a locked cage and an electronic firewall.

While we use industry-standard precautions to safeguard your personal information, we cannot guarantee complete security. 100% complete security does not presently exist anywhere online or offline.

- Server Resource
Any website that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and resources) will be given an option of either paying extra for a dedicated server / semi-dedicated server (which depends on the resource needed) or reducing the resource used to an acceptable level Resume Hype shall be the sole arbiter of what is considered to be a high server usage level.

- Background Running Programs Resume Hype does not allow background Daemons such as IRC bots; eggdrop; BitchX; XiRCON; and any other program that interferes with normal server operation. Resume Hype does not allow IRC or IRC bots to be operated on our servers.

- Backups
Resume Hype performs daily backups on all servers to ensure critical files are never lost. However Go Green Resumes is NOT responsible for lost data, time, income or any other resource due to faulty backups or non-existent backups. Please always backup your own data for Redundancy.

- Customer Responsibility The customer is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery. The customer is responsible for securing their username/password. The customer assumes responsibility for all material on their site. Use of Resume Hype service requires a certain level of knowledge in the use of word processing. The customer agrees that he or she has the necessary knowledge to create and maintain their web space. Customer agrees that it is not the responsibility of Resume Hype to provide this knowledge or support outside matter specific to Go Green Resumes.

- UCE (Unsolicited Commerce Email) - SPAM Spamming, or the sending of mass unsolicited email, from or through a Resume Hype server or using an email address that is maintained on a Resume Hype server is STRICTLY prohibited. Resume Hype will be the sole arbiter as to what constitutes a violation of this provision. If you engage in any of the foregoing activities using the service of another ISP or IPP, but channeling activities through a Resume Hype server as a mail drop for responses, you are in violation. Violators will be assessed a minimum .00 fine and will face immediate suspension.

- Server Abuse
Any attempts to undermine or cause harm to a Resume Hype server or customer of Resume Hype is strictly prohibited. Any sites on Resume Hype and dedicated servers must adhere to the above policies. The failure to meet or follow any of the above guidelines is grounds for account deactivation. We reserve the right to remove any account without prior notice.

- Software Distribution
Resume Hype accounts are not to be used for the purposes of distributing software and multimedia products.

- Multimedia Files
Multimedia files are defined as any graphics, audio, and video files. Resume Hype accounts are not to be used for the purposes of distributing and storing unusual amount of multimedia files. Any Resume site whose disk space usage for storing the multimedia files exceed 70% of its total usage, either in terms of total size or number of files, will be deemed to be using unusual amount of multimedia files.

- Actions Taken by Resume Hype
The failure by a customer to meet or follow any of the above policies/terms is grounds for account deactivation. Resume Hype will be the sole arbiter as to what constitutes a violation of the ACCEPTABLE USE POLICY. Resume Hype reserves the right to remove any account without prior notice.

When Resume Hype becomes aware of an alleged violation of its ACCEPTABLE USE POLICY, Resume Hype will initiate an investigation. During the investigation, Resume Hype may restrict a customer's access in order to prevent further potentially unauthorized activity. Depending on the severity of the violation, Resume Hype may, at its sole discretion, restrict, suspend, or terminate a customer's account and/or pursue other civil remedies. If such violation is a criminal offense, Resume Hype will notify the appropriate law enforcement authorities of such violation.
Resume Hype does not issue credits for outages incurred through service disablement resulting from ACCEPTABLE USE POLICY violations.

Resume Hype customers agree to indemnify and hold harmless Resume Hype from any claims resulting from the use of our services that damages them or any other party. The Resume Hype service is provided on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement Resume Hype expressly disclaims any representation or warranty that Resume Hype service will be error-free, secure or uninterrupted.
No oral advice or written information given by Go Resume Hype, its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice. Resume Hype and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.

- Modification
Resume Hype reserves the right to add, delete, or modify any provision of this Policy at any time without notice.

- Refusal of Service
We reserve the right to refuse, cancel, or suspend service at our sole discretion within human reason.
